16. Definitions

For the purposes of this Privacy Policy, the following terms have the meanings set out below:

"Platform"
The AI Image Generation Platform operated by Undresso Media Group SRL, including all associated services such as the AI Model Marketplace and any other features or functionalities offered through www.seduced.ai.
"User"
Any individual or entity accessing or using the Platform, including Contributors, Buyers, Registered Users, and Visitors.
"Contributors"
Individuals or entities who upload content to the Platform, such as AI Models, for the purpose of monetization or sharing with other Users. Contributors may also undergo model verification processes to have their likeness used in AI Models.
"Buyers"
Users who subscribe to access AI Models on the Marketplace for content generation within the Platform. Buyers utilize the AI Models provided by Contributors to generate images, videos, or other media based on custom prompts.
"Personal Data"
Any information relating to an identified or identifiable natural person, as defined under the General Data Protection Regulation (GDPR). This includes data such as names, identification numbers, location data, online identifiers, or factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
"Processing"
Any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation, retrieval, consultation, use, disclosure, restriction, erasure, or destruction.
"GDPR"
General Data Protection Regulation (EU) 2016/679, the European Union regulation on data protection and privacy for all individuals within the EU and the European Economic Area, which also addresses the transfer of personal data outside the EU and EEA areas.
"Third-Party Service Providers"
External companies or individuals engaged by Undresso Media Group SRL to perform services on its behalf, such as payment processing, cloud storage, verification services, analytics, customer support, and communication services. These providers process personal data as necessary to perform their functions, subject to contractual obligations regarding confidentiality and data protection.
"Consent"
A freely given, specific, informed, and unambiguous indication of a data subject's wishes by which they, through a statement or clear affirmative action, signify agreement to the processing of personal data relating to them.
"Model Verification"
The process by which Contributors provide identification documents, selfie images, and consent forms to verify their identity and authorize the use of their likeness in AI Models, especially for features like face replication and AI Model training.
"AI Model"
A model that has been trained using the Platform's AI technology with data provided by Contributors. The AI Model is used to generate content based on User prompts and is accessible to Buyers through subscriptions on the Marketplace.
"Marketplace"
The online platform where AI Models are listed and made available through subscription by Contributors to Buyers for content generation within the Platform.
"Generated Content"
Images, videos, or other media created by Users utilizing the Platform's AI technology, based on custom prompts or AI Models. Users retain ownership of their Generated Content, subject to compliance with the Platform's Terms of Service and this Privacy Policy.
"Technical Data"
Information collected during your use of the Platform that does not directly identify you, such as IP addresses, browser type and version, device identifiers, cookies, and usage statistics.
"Communication Data"
Information provided by Users when they communicate with us, including email addresses, messages, inquiries, support requests, and any other information voluntarily submitted through contact forms or other communication channels.
"Legal Basis"
The justification under GDPR for processing personal data, such as consent, performance of a contract, compliance with a legal obligation, protection of vital interests, public interest, or legitimate interests pursued by the Data Controller or a third party.
"Data Controller"
Undresso Media Group SRL, the entity that determines the purposes and means of processing personal data collected through the Platform.
"Data Subject Rights"
The rights granted to individuals (data subjects) under GDPR regarding their personal data, including the rights of access, rectification, erasure, restriction of processing, data portability, objection, and the right not to be subject to automated decision-making.
"Cookies"
Small text files stored on a User's device by their web browser when accessing the Platform. Cookies are used to enhance the User's experience by remembering preferences, enabling functionalities, and collecting analytical data to improve the Platform's performance.
